1831 will 24 [month omitted, but supplied in the codicil], codicil 15 Sep 1832, executors wife Maria & son Edward. In 1831-2 he bought a 48th part of the Manor of Brixham from Mr Chance Brooking & 2 houses in Fore St, Brixham, from Mrs Elizabeth Wheaton.

1831 will.
This is the last will and Testament of me Edward Vittery of Brixham in the County of Devon Shipowner.
I give and devise unto my Son Edward Vittery all that my share and interest in the Manor or reputed Manor of Brixham aforesaid to hold the same unto my said Son his heirs and assigns for ever.
Also I give and bequeath the sum on one hundred and fifty pounds apart to each of my daughters Maria Pellow Vittery, Mary Vittery, Susan Vittery and Jane Vittery to be paid and become payable to them at the expiration of six calendar months after the decease of my wife Maria Vittery, she my said Wife to have and receive the interest thereof during her natural life all the Rest Residue and Remainder of my Real and Personal Estate and Effects of what nature or kind soever.
I give devise and bequeath the same unto my said dear wife for and during the term of her natural life subject to the proviso hereinafter contained, she paying thereon all my just debts and Funeral and Testamentary expences and from and after the decease of my said wife devise and bequeath the same unto my said Son and Daughters their Heirs Executors Administrators and Assigns as tenants in common and not as joint Tenants Provided always and my will is that in case my said wife shall happen to marry again then and from and immediately after that event the estate for life of my said wife of and in my said residuary estate and effects so devised to as aforesaid shall cease and be utterly void.
And I give devise and bequeath the same in manner following as to that part of my said Residuary Estate which consists of Freehold I give and devise unto my said Son and Daughters their heirs and assigns for ever as Tenants in common and not as joint Tenants and as to that part of my said residuary estate and effects which consists of personal property I give and bequeath one third part thereof the whole into three equal parts to be divided) unto my said wife her Executors Administrators and Assigns for her own use and benefit she in consideration thereof to release all her right and title to dower of and in the said Manor so devised to my said Son as aforesaid and the two remaining third parts thereof I give an bequeath unto my said Son and Daughters their Executors Administrators and Assyns equally to be divided between them share and share alike as Tenants in common.
And I appoint my said wife Maria Vittery and my said Son Edward Vittery Executrix and Executor of this my will hereby revoking all former wills by me made.
In witness whereof the said Edward Vittery have hereunto set my hand and Seal the Twenty fourth day on thousand eight hundred and Thirty one Edward Vittery Signed Sealed published and declared by the said Edward Vittery as and for his last will and Testament in the presence of us whom his presence and in the presence of each other at his request have subscribed our names as witnesses hereto - John Reed - Latitia Hyne - Mary Curtis Hyne.
1832 codicil to the will.
This is a Codicil to the last will & Testament of me Edward Vittery of Brixham in the County of Devon Shipowner bearing date the Twenty fourth day of May One Thousand eight hundred and thirty one and which I desire my be considered as annexed to and be taken as part thereof.
Whereas I have by my said will given the sum on one hundred and fifty pounds apiece to each of my daughters payable at the expiration of six months after the decease of my wife now I do hereby revoke the said legacy of one hundred and Fifty pounds apiece as given to my said daughters and whereas since making my last will I have purchased of Mr. Charles Brooking one Twelfth part of one fourth of the Manor of Brixham aforesaid and whereas since making my said will I have also purchased of Mrs. Elizabeth Wheaton all those two Messuages or dwelling houses Yard and Premises situate in the Fore Street of Brixham aforesaid in the respective occupations of Mr. Lanford Upholster & Mr. Blackmore Shipowner and Mr. Maddick Mason and others, now I do devise the said one Twelfth part of one fourth part of the said Manor and also the said Messuages or dwelling houses Yard and Premises with the appurtenances unto my dear wife for and during the term of her natural life or as long as she shall continue my Widow and from and immediately after her decease or second marriage which ever shall first happen as to the said one twelfth part of one fourth part of the said Manor I devise the same unto my four Daughters and my Son share and share and share alike To hold to them their heirs and assigns for ever as Tenants in common and not as joint Tenants.
And as to the said Messuages or dwelling houses Yard and Premises in Fore Street I devise the same unto my four daughters and my Son equally between them in share and share and share alike To hold to them their heirs and assigns for ever as Tenants in common and not as joint Tenants.
In witness whereof I have hereunto subscribed and set my hand and Seal this fifteenth day of September in the year of our Lord One Thousand eight hundred and Thirty Two. Ed Vittery Signed sealed published and declared by the said Testator Edward Vittery for a Codicil to his last will and Testament in the presence of us who at his request in his presence and in the presence of each other have hereunto subscribed our names as Witnesses, the XXX in the third and last lines of this last sheet being first made - Latitia Hyne - John Reed - R W Woolston Sol Brixham.
1837 probate.
Proved at London with a Codicil 20th. December 1837 before the Judge by the oath of Maria Vittery Widow the Relict one of the Executors to whom administration was granted having been first sworn by Common [?] duly to administer power XXX of making the like grant to Edward Vittery the Son the other Executor when he shall attain the age of Twenty one years and apply for the same.
